Terms of Service

Please read these terms before using Fluent With James.

Welcome to Fluent With James (“we”, “us”, “our”). By booking, purchasing credits, or using the Student Space, you agree to these Terms of Service.

1) Who operates this service

Operator: Fluent With James (Emrys Rowles). Contact: emrysrowles@outlook.com.

2) Eligibility & accounts

  • You must be 13+ to use the service. If under the age of majority in your country, you confirm parental/guardian consent.
  • Access is email-based (password-free). You’re responsible for keeping your email secure and for actions taken in your account.

3) Lessons, scheduling & rescheduling

  • Lessons are delivered via Zoom and scheduled through our live calendar (auto time-zone handling).
  • You can reschedule or cancel up to 12 hours before the start time via the “Manage Booking” tools.
  • Late cancellations (< 12h) or no-shows normally forfeit the credit; message us if exceptional circumstances apply.

4) Credits, pricing & payments

  • Credits correspond to 45-minute lessons and do not expire.
  • Payments are processed securely by Stripe/PayPal/Apple Pay/Google Pay; we do not store card details.
  • If you’re not happy after your first paid lesson, contact us for a refund of the entire pack.
  • Prices may change; posted prices at purchase time apply to that order.

5) Transcripts & learning data

  • We create a transcript for each lesson to generate feedback and learning tools (Learning Tree, Growth Guide, games, and progress views).
  • We don’t store Zoom video/audio. Data handling is described in our Privacy Policy.

6) Acceptable use

  • Be respectful. No harassment, hate speech, or illegal activity.
  • Do not attempt to disrupt the platform, misuse credits, or share harmful content.

7) Intellectual property

  • Platform design, content, text, code, and assets are owned by us or our licensors.
  • You may use your Student Space for personal learning; do not copy, resell, or redistribute platform content without permission.

8) Third-party services

We rely on providers like Stripe, PayPal, Google Calendar, Zoom, and (currently) Krisp AI. Their services are subject to their own terms and policies.

9) Disclaimers

We provide the service “as is” and “as available.” We strive for reliability but do not guarantee uninterrupted access (e.g., network or provider outages).

10) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our aggregate liability for any claim relating to the service will not exceed the amount you paid in the 3 months preceding the claim.

11) Indemnity

You agree to indemnify and hold us harmless from claims arising from your misuse of the service or violation of these terms.

12) Suspension & termination

We may suspend or terminate access for violations of these terms, abusive behaviour, or security risks. You can stop using the service at any time.

13) Changes to these terms

We may update these terms. We’ll post changes here and update the “Last updated” date; material changes may be communicated via email or in-app notice.

14) Governing law

These terms apply globally. If a specific local law requires different terms, those will prevail to the extent required by law.
